This week's Supreme Court of Canada leave applications are fascinating.

A big criminal Charter case out of Quebec that our model gives 50%, three indigenous rights cases at between 12-18%, and a COVID case brought by the CCLA out of NL at 9%: litigate.com/data-driven-de…

Quite the week!

A reminder that what has gone up to 66.67% is the capital gains inclusion rate (for capital gains above $250K).

The marginal tax rate high earners will pay on capital gains is at most ~35%.

High earners still keep at least 65% of capital gains. The middle class much more.

Canadian law students: It's the SCC's fault that you have so much reading to do!

Losing is an important part of the job for all litigators: appellate, trial or otherwise.

Losing sucks. But as a colleague once told me, if you’re not losing, you’re not taking hard enough cases.

Big decision today. Where there is an appeal on a W of law, judicial review on fact/mixed fact and law is available and no longer limited to exceptional circumstances. OCA is wrong. FCA is right.

The only author cited is Paul Daly—twice!
