Is it bad that the declaratory theory of law is beginning to look more and more convincing the longer I look into it (and the alternatives)? 😅

If anyone could point me in the direction of criticism (or at least analysis) of SCC "creativity" aka just making stuff up/changing settled rules (especially in the private law arena, stare decisis, judicial role etc) I'd be eternally grateful 🙏
