Judge Wilken tells lawyers she has serious problems with 3rd-party NIL restrictions. She tells lawyers she'll "throw it back on you all to find something workable, something consistent" and keeping in mind that "taking things away from people doesn't work well"

Jeffrey Kessler wants Judge Wilken to set a deadline because there's a chance they can't reach a new settlement and the cases go back on the docket. Pretty stunning development. This NCAA settlement that's been talked about like a done deal now has a good chance of collapsing.

Tough decisions lie ahead for the NCAA. Will it take a chance?

Exhibit A for the proposition that the people influencing decisions about NIL are still in denial and continue to press for a strategy that won’t end well: A school president to Yahoo Sports: “There’s no reason to settle under these circumstances. Go to trial.”

This is the NCAA's conundrum. If NCAA rejects a free (or more free) market for NIL, then settlement falls apart and litigation resumes, and NCAA probably loses given Judge Wilken's views. But NCAA worries NIL has become pay-for-play. If only NCAA had listened to Ed O'Bannon.

UGA’s President doesn’t seem to understand that a class action adjudicates the rights of absent third parties, and settlements must be approved to make sure those third parties - college athletes, in this case - aren’t getting screwed. Don’t screw the athletes. Case closed. ✅
