Divisional court finds turning off public road into factory goo.gl/maps/HTKBRCk5d… not dedicated as highway, although public may have deviated from straight-across line of interrupted pavement. If it had been highway, the protesters could have been arrested for obstruction.

National Archives has been busy adding local Acts to legislation.gov.uk — there are now hundreds for each of many years in the C19, including railway, canal and inclosure Acts. Useful aid for rights of way research. Thx to @charlescholland for illuminating the developments.

Now up to one year in gaol for obstructing public paths under s.137 Highways Act 1980 legislation.gov.uk/ukpga/1980/66/…. But what's this in new subs.(1B)? A developer with a temporary traffic regulation order on a public path can be convicted of obstruction notwithstanding the closure?

Delightful walk yesterday along Morchard Bishop restricted byway 55 at Middlecott, added to the Devon definitive map and statement several years ago. There are 100s more like this in Devon yet to be added—now the 2026 cut-off has been abandoned thanks to ⁦Richard Benyon⁩.

This is a pretty damning assessment of the Bill's impact assessment—it really could not attract a worse rating. Ironic that a supposedly deregulatory Bill gets the thumb's down from the Government's guardian of regulatory impact.

We’re delighted that an order has been confirmed to add a Restricted Byway and Byway Open to All Traffic to the Definitive Map on the Hampshire/Berkshire border. (1/2)

Not wild about camping: pannageman.craddocks.co.uk/2023/01/14/not…. Why yesterday's judgment in the High Court, finding no right to camp on the Dartmoor commons, ought to be appealed on the basis of the history of statutory provisions for access to common land.

We’ll be joining Dartmoor National Park in court appealing the wild-camping case, represented pro bono by top silk Richard Honey KC and FTB Chambers colleagues—and a witness statement from me.

Not long to go before the Court of Appeal hearing in the 'wild camping' case. The second tweet in the thread below includes a link to the Open Spaces Society's skeleton argument as intervener and my witness statement.

The Guardian on digital mapping. Clancy Wilmott, Berkley professor in digital cartography, said: 'An OS map shows you where a stile is for horses; I’m not sure Google Maps even knows what a stile is.' I'm not sure even Prof. Wilmott knows what a stile is. theguardian.com/travel/2023/au…

Bit surprised SC granted permission, as though of national interest, the right to wild camp relates only to Dartmoor—although in Open Spaces Society view, the interpretation of the legislation has much wider impacts. Perhaps the SC agrees.

Speaking to Claire Marshall we met to talk about just one of thousands of obstructed paths. @cornwallcouncil should be enforcing against offenders (those that break the law) & recovering its costs from offenders. It’s not taking its duty seriously #cornwall bbc.co.uk/news/science-e…

While we wait (now 24 years after CROW 2000 was passed) for Defra to prepare draft exceptions to the extinguishment of unrecorded rights of way at end 2030, I've had a go at explaining the <mandatory> exceptions in s.54. And there are some surprises: pannageman.craddocks.co.uk/2024/01/17/sta…
