FYI, the #EmergencyAct decision found that Charter sections 2(b) (expression) and 8 (unreasonable seizure) were breached, but found these sections were not breached: s.2(c) - peaceful assembly; s.2(d) - freedom of association; s.7 - life, liberty and security of the person.
The judge in the #EmergencyAct decision did find that (contrary to the Commission) that the threshold for invoking the EA wasn't there because Ontario could have done more under existing laws, so its use was ultra vires (beyond the govt's power to invoke). But weirdly...
The #EmergencyAct itself was not declared unconstitutional. The application of it in this case on the facts did not meet the 'reasonable limits' test for sections 2(b) and 8. There is a difference.
