Just think about how you’d feel as a client if your lawyer explained that the regulatory guidance on a federal government agency website isn’t dispositive and you might still go to prison if you follow it but that you can’t ask the prosecutors for guidance in the alternative.

Government over reach like this doesn’t just threaten crypto and private payments, it threatens all kinds of open source decentralized software projects. If a software developer that makes a privacy wallet is liable for transactions, why not an encrypted messaging app developer?

Peter Van Valkenburgh Their 'locked parcel' analogy also fails because the carrier of the parcel *does* have some control over the parcel. For example they could lose it or destroy it.

The only thing non-custodial wallets can do is fail to tell the recipient that the transaction exists.
