Just think about how youโ€™d feel as a client if your lawyer explained that the regulatory guidance on a federal government agency website isnโ€™t dispositive and you might still go to prison if you follow it but that you canโ€™t ask the prosecutors for guidance in the alternative.

Government over reach like this doesnโ€™t just threaten crypto and private payments, it threatens all kinds of open source decentralized software projects. If a software developer that makes a privacy wallet is liable for transactions, why not an encrypted messaging app developer?

Peter Van Valkenburgh Their 'locked parcel' analogy also fails because the carrier of the parcel *does* have some control over the parcel. For example they could lose it or destroy it.

The only thing non-custodial wallets can do is fail to tell the recipient that the transaction exists.
