Wonderful piece. A lot here applies to constitutional theory as well—much more depends on the temperate of the theorist/judge (whether they're an order muppet or a chaos muppet, to borrow Dahlia Lithwick's wonderful distinction) than anything else.

Every campus is different, but one lesson I draw from recent student protests is that most universities that want to enforce rules should do so first with school discipline of their students—various kinds of suspensions, even expulsion—instead of police action.

Huge downsides: 1) Constricting honest discourse even further on campuses where speech policing is already out of hand, 2) Additional staff who, as DEI illustrates, will start expanding its powers, pushing higher education further away from its core mission.
