Sports journalist Daniel Libit requested contract UW-Madison had w/ Altius. UW-Madison said it had no responsive records. Libit pointed to the Altius announcement & asked again. UW-Madison said UW Foundation held the contract. Libit sued. jsonline.com/story/news/edu…

A judge just tossed the suit, saying Libit should have requested the contract held by the foundation. "It would be unreasonable to require a records custodian to assume that Libit intended to obtain a different contract, the one b/w UW Foundation & Altius," the judge wrote.

Here’s ⬇️ an update via Journal Sentinel on my public records lawsuit against UW–Madison and its foundation, which was dismissed after the foundation turned over a copy of its Altius Sports Partners agreement. The crux of the legal dispute remains unresolved. I’m weighing next options.

This is key: Judge Wilken just said "I think we have problems with this" and tells the NCAA and players' attorneys you need to come up with something better. She does not like the settlement restricting NIL opportunities and thinks it will take away from athletes' opportuities.

In summation as the hearing winds down... The NCAA’s House settlement is on hold, as Judge Claudia Wilken has ordered the parties to amend language in the settlement related to limiting third-party/booster pay to athletes. They will get back to her in three weeks.
