For almost all small business and landlords their median annual capital gain is zero with one year showing it all. Average capital gain will be far under the $250k limit with that one year being far over. Median is usually the best way to look at data but not in this case.

Capital gains tax on rentals and unincorporated small business is like saying that we will only do income tax in your retirement year. We will add up all of your years of income and you will pay tax on that total amount in the year your retire at the applicable rate on the total.

Many who own a business that they eventually sell will be hit with this in the one year that they sell. These are the moments and pop operations that will see their retirement plans compromised. This will be an 8% reduction in their entire nest egg.

The easy and fair way to apply this with respect to a long held asset that is disposed of in one calendar year is to allow the $250k or a lesser amount to accrue per year for the period of ownership.

Most Ontarians benefit financially from the carbon tax and the associated rebates. The only ones who pay more are those wealthy enough to over consume. One PC cabinet minister complained about his bill but it turns out he had a heated driveway and swimming pool heater.
