The en banc declined to rehear Parrish v. United States. Six judges voted for rehearing, and Judge Gregory wrote a dissent.

It's a big day for employment law! This morning, the DOL announced its overtime final rule (raising the minimum salary for exempt workers) & this afternoon the FTC will hold its meeting on (potentially banning) noncompetes.

Both rules are likely to face legal challenges.
